A TV model has been sentenced to a suspended prison term and fined after admitting to making a false rape accusation against Theo Hernandez, the AC Milan defender. Luisa Kremleva, a Russian-born television personality, was previously scheduled to stand trial in October 2024, but her lawyer abruptly cited a “medical emergency,” leading to a suspension of proceedings. Kremleva, 28, also chose to stay away from the courtroom in Malaga, Spain, likely due to the media attention surrounding the case.

After months of legal delays, Kremleva ultimately reached a plea deal with prosecutors, admitting to perjury in relation to her false claim that Hernandez had raped her outside a nightclub in Marbella. On January 9, 2025, the details of her plea bargain were made public, revealing that she had been handed a six-month suspended sentence and fined £1,500. The court also warned that if she commits another offense in the next two years, she could face actual jail time.

The case began back in 2017 when Kremleva accused Hernandez of raping her after a night out at a Marbella nightclub. She claimed the incident occurred in the back of a Porsche outside the club. The police quickly launched an investigation, but the case soon began to fall apart. CCTV footage from the nightclub’s parking lot revealed that Kremleva had fallen by accident and had not been forcibly thrown out of the car, as she had initially alleged. Additionally, police obtained a text message from Kremleva sent to Hernandez several hours after the supposed attack, asking him when he would come back to see her.

The footballer, who has represented France at an international level, was never arrested or charged. The investigation into the rape claims was swiftly closed, and Kremleva was instead charged with making a false criminal complaint. In January 2020, Kremleva was arrested after she failed to respond to a court summons. Her legal troubles grew as the case progressed and her accusations were deemed to be fabricated.

Kremleva’s trial, which had already been delayed multiple times, was further postponed due to medical issues she allegedly faced in her home country of Russia. The charges against her included the malicious fabrication of a rape story to harm Hernandez’s reputation. According to the prosecution’s indictment, Kremleva fabricated the rape claim after Hernandez refused her advances and declined to stay the night with her after their consensual sexual encounter in the Porsche. Prosecutors argued that she had been motivated by revenge after Hernandez refused to engage with her further.

Interviews following the closure of the police investigation, Kremleva continued to maintain her story, claiming she had physical evidence of the alleged assault. She also demanded an apology from Hernandez, further fueling the media attention around the case. Her mother, Mila, also spoke out, asserting that Kremleva was not under arrest and that the truth would eventually come to light.

As part of the plea bargain agreement, Kremleva admitted that her claims were malicious, acknowledging that she had fabricated the rape story as revenge for Hernandez’s refusal to pursue a relationship with her. The plea deal allowed her to avoid a potential two-year prison sentence if she had gone to trial and been convicted.

The court’s judgment on the case concluded with a detailed account of the events leading to the false claim. It was found that both Kremleva and Hernandez had consensual sex before she tried, unsuccessfully, to persuade him to stay with her. After a confrontation with other women in Hernandez’s group, Kremleva later fabricated the rape story and filed a police report, claiming that Hernandez had forced himself on her.

For Hernandez, the years-long ordeal has had a considerable impact, though he was ultimately cleared of any wrongdoing. The legal battle has tarnished his reputation, and despite his clearance, his name was associated with the incident in the media for some time. Hernandez has since refocused on his football career and is reportedly in talks to renew his contract with AC Milan, potentially making him one of the highest-paid players at the club.

Kremleva’s case serves as a reminder of the serious consequences of making false accusations, particularly when they have the potential to cause significant damage to the lives of those involved. In this case, the false rape claim has not only affected the reputation of Hernandez but also led to a lengthy legal process for Kremleva, culminating in her conviction.
